六、违约责任

五、违约责任

根据《中华人民共和国合同法》、《中华人民共和国城市房地产管理法》及其他相关法律法规的规定，在平等、自愿、协商一致的基础上，甲乙双方就下列商用房的租赁达成如下协议，并签订本合同：
第一条： 房室基本情况

第三条： 合同期限、租用标准

第五条： 商用房交付及收回
1、甲方收到乙方保证金及首期租金后即将商用房移交给乙方，乙方接收该商用房以目前现状为准。
2、合同期满或中途解除合同，乙方应立即搬离并交还承租商用房给甲方。交房时乙方原有的装修配套设施亦无条件交归甲方。
3、如因乙方未能履约付租金导致合同解除，甲方可以提前通知（或在承租商用房门口张贴通知信函）甲方要求收回商用房，乙方应按通知要求腾空并交还承租商用房。逾期不交还承租商用房时，甲方有权采取包括换锁等手段在内的措施收回商用房。对于乙方在承租商用房内所有遗留物品，甲方有权自行外理，乙方无权向甲方索要或索赔。
第六条： 关于商用房产权（使用权）的承诺
1、甲方保证所出租的商用房产权清楚，没有纠纷，有其合法的出租资格。若因商用房产权发生纠纷，导致乙方无法使用商用房，由甲方承担责任。
2、乙方有权根据市场需要自由设置其经营项目并对其经营承担市场风险。在乙方申办相关证照时，甲方同意出具有交的相关手续。其申办成功与否，以及所需支付的费用，均由乙方负责。
第七条： 商用房维修责任
租赁期间，乙方对承租商用房及其设施应妥善管理、积极维护并负责修缮。
租赁期间，有关防火安全、门前三包、综合治理及安全保卫等工作，乙方应执行当地有关部门的规定，同时还应服从甲方及有关部门的监督检查。
第八条： 商用房改造及装修
乙方可以根据需要对承租商用房进行装修，但乙方的装修方案事先应报甲方批准同意，同时承诺在进行装修（含房屋隔断、消防、环保设施等）时委托在相关资质的设计、施工、安装企业进行，如需报建和验收，乙方还应自学办理报验手续。乙方同时保证：
1、在屋装修时，绝不破坏商用房结构安全;
2、保证原有的设施（包括水、电、暖）不被破坏，如需改造或增添设施，应委托专业公司安装施工，平时保证合理使用并使其功能良好。否则，如因乙方未能执行上述约定，导致出现任何不良后果，均由乙方负责。
3、如果装修厨房、卫生间或其他与水相关的用途，则按规定做好防水层且须经过闭水室验，保证不会出现渗漏问题。否则，乙方应负责返工重做。如果造成甲方或相邻商户损失，乙方应负责赔偿。
4、因乙方装修施工不当或因使用、维护不当造成诸如商用房和附属设施损坏等情况，影响到甲方或第三方的，由乙方承担相应责任。

第十二条： 违约责任
本合同签订后，双方均必须依合同约定履行义务，享有权利，任何一方违反合同的约定或下列各项内容时，必须承担违约责任。
一、甲方有权在乙方有下列情形时，可以采取包括停水、停电在内的强制措施，催收租金或提前收回租赁商用房，租赁合同也随即终止。
（1）、乙方擅自将承租商用房转租、抵押、调换使用或改变用途，转借他人时;
（2）、乙方未按合同规定支付租金，每逾期一天则应按每日300元的标准向甲方付违约金，逾期满7天乙方仍不履行支付租金及违约金时;
（3）、乙方破产或进行清盘（包括法院查封）而无法履约付租时;
甲方因上述原因决定收回商用房时，有权要求乙方限期搬迁退房，超过搬迁期限后，视乙方为搬迁完毕，商用房内如有遗留物品，则视为乙方主动放弃，甲方有权自行处理，乙方无权追偿。如果乙方无理占房不退，甲方有权采取强烈措施（包括停水、停电、强行进入等）且有权追索乙方占有商用房的赔偿责任。
第十三条： 免责条款
因不可抗力原因（包括地震，洪涛等）导致该商用房损坏或造成损毁并致使本合同无法履行时，双方同意解除本合同并互不承担责任。
第十四条： 其他事项
1、乙方在装修及日后经营过程中，不能出现扰民现象，否则乙方应负责整改，因此引起的后果责任由乙方承担。
2、在商用房管理工作中，遇到突发事件（如火灾、漏水、煤气泄露等）甲方有权在乙方不在场的情况下，进入乙方承租商用房。如在采取应急措施防止事故扩大的行为中影响了乙方并给乙方造成损失的，乙方表示理解并不要求甲方承担赔偿责任。
3、甲乙双方确定信函（包括其它文字）投递的合同与有效地址为：（a）甲方以合同首页所述地址为准（b）乙方以上述承租商用房所在地址为准。甲方在无法联系到乙方的情况下，可以在乙方承租商用房门口张贴通知信函。此张贴的通知信函等同于甲方依法履行了告知义务。
第十五条： 争议的解决
本合同执行过程中如发生纠纷，双方同意协商解决，协商不成时，双方同意通过法院解决。
第十六条：
本合同未尽事项，由甲乙双方另行补充合同，补充合同与本合同不一致的 以补充合同为准。
第十七条：
本合同经双方法定代表人或委托代理人签字后生效，一式二份，甲方执一份，乙方执一份。传真件具有同等法律效应。补充事项：
